L90 Files Lawsuit Against DoubleClick Alleging Fraud on the Patent Office and Unfair Business Practices

- L90, Inc., a leading provider of Internet advertising and direct marketing solutions, announced that it filed suit Friday against rival DoubleClick, Inc. in the Federal District Court for the Southern District of New York.

The lawsuit alleges unfair business practices, including DoubleClick's fraudulent procurement and unlawful assertion of its recently issued U.S. patent. The complaint seeks an order from the Court enjoining DoubleClick's unlawful conduct, and awarding to L90 monetary and punitive damages. L90's suit also asks for a declaration from the Court that DoubleClick's patent is invalid and unenforceable.

"As I have stated before, there were a number of companies serving ads before DoubleClick filed their patent application," states John C. Bohan, President and CEO of L90. "We still feel extremely confident that these prior art examples invalidate their patent. Moreover, as set forth in our lawsuit, we believe that DoubleClick has intentionally and willfully engaged in unfair business practices, and as a result we will be seeking damages well into nine figures." Thomas J. Nolan of Howrey Simon Arnold & White, LLP, L90's outside counsel for the lawsuit, adds that as asserted in the lawsuit "DoubleClick committed fraud on the patent office in obtaining its patent, and therefore the patent is unenforceable."
