L90 Files
Lawsuit Against DoubleClick Alleging Fraud on the Patent Office and Unfair
Business Practices
- L90, Inc.,
a leading provider of Internet advertising and direct marketing solutions,
announced that it filed suit Friday against rival DoubleClick, Inc. in the
Federal District Court for the Southern District of New York.
The lawsuit alleges unfair business practices, including DoubleClick's
fraudulent procurement and unlawful assertion of its recently issued U.S.
patent. The complaint seeks an order from the Court enjoining DoubleClick's
unlawful conduct, and awarding to L90 monetary and punitive damages. L90's suit
also asks for a declaration from the Court that DoubleClick's patent is invalid
and unenforceable.
"As I have stated before, there were a number of companies
serving ads before DoubleClick filed their patent application," states John
C. Bohan, President and CEO of L90. "We still feel extremely confident that
these prior art examples invalidate their patent. Moreover, as set forth in our
lawsuit, we believe that DoubleClick has intentionally and willfully engaged in
unfair business practices, and as a result we will be seeking damages well into
nine figures." Thomas J. Nolan of Howrey Simon Arnold & White, LLP,
L90's outside counsel for the lawsuit, adds that as asserted in the lawsuit "DoubleClick
committed fraud on the patent office in obtaining its patent, and therefore the
patent is unenforceable."

Consulting Unveils New Web-Based Business Simulation Offering
-
BRB Consulting Ltd (BRB) today
announced the launch of their management games for corporate websites. BRB
offer corporations a powerful incentive for potential clients to visit and
revisit their website through the medium of competition.
"Our
clients are hooked on these games", says Lee Jones, Chairman and CEO of BRB
Consulting, "As soon as they start, they can't wait to play again,
especially against the boss!" Users "play" a role in the game,
making managerial decisions and evaluating the resulting performance. In many
cases, a scoring system can be used to assess overall performance and present an
obvious challenge! The games can be stand alone or multi-player, allowing
individuals or teams to compete, or cooperate within the simulated business
environment created by the package. The information presented to players can be
exhaustive or sketchy, helping to underline the value of timely accurate
business intelligence.
Although the emphasis has so far been on the fun factor, these
simulations can play a more serious educational and managerial role. "We
use the System Dynamics approach to simulation development wherein
cause-and-effect relationships are identified, together with any resulting
feedback loops. Most organizations are aware that there are consequences of
their actions and some use simulation to evaluate the behavior of their business"

development of Business Simulations and Management Games. Experience gained from
years in the development of war games for the military has been used to create
an offering combining state-of-the-art networking and web-based business
